Kenneth Fuller, in prison for an affair with a minor, will be allowed to leave twice a week.
Kenneth Fuller, the former Rustin swim coach who pleaded guilty in January to having an affair with a 17-year-old team member, will be allowed to leave prison twice a week on work release, a judge decided on Thursday. While Fuller was sentenced on March 5 to seven-to-23 months in prison, according to the Daily Local News, Judge David Bortner decided that Fuller will be allowed to leave the county prison two days each week during his sentence to work from his home office. Fuller, a wastewater engineer, will be cleared to leave on Monday and Thursday from 9 a.m. to 5 p.m., but must return to prison at the end of each day. Kenneth Fuller is going to jail. The former Bayard Rustin swim coach who pleaded guilty in January to having sex with a 17-year-old member of his team will serve a 7-to 23-month sentence after a judge rejected his appeal to remain free, the Daily Local News is reporting. On Tuesday, in the courtroom of Judge David Bortner, Fuller, 48, told the judge he wished to avoid jail time so he could take care of his family. The Daily Local reports that former Rustin swimming coach Kenneth Fuller plead guilty on Wednesday to having sex with one of the members of his swim team. According to the Daily Local: Kenneth Fuller stood before Common Pleas Court Judge David Bortner and admitted that he had taken the girl, then 17 years old, to a hotel and an area park in the spring of 2012 and had sex with her after supplying her with alcohol. He also admitted that he had helped fake a doctor’s letter for her that would excuse her from missing class when the two had one of their trysts. A Common Pleas Court judge rejects a request by the prosecution to overturn the former Rustin swim coach's bail.
The Daily Local reports that a Common Pleas Court judge rejected a request by the prosecution in the Rustin swim coach case to overturn the bail for Kenneth Fuller after he allegedly made contact with the victim after his arrest. According to the Daily Local: Following a two-hour hearing, Judge David Bortner said that although he believed there had been some level of impermissible communication between Kenneth Fuller and the teenage girl, he did not have enough evidence to send the man to Chester County Prison to await trial, as had been suggested by the prosecutor in the case. Former Rustin swim coach Kenneth Fuller will appear in court on Thursday for his formal arraignment. Fuller faces several charges of institutional sexual assault after he had sex with a underage member of his swim team three times between April 27 and May 5. His arraignment is scheduled for June 14 at 9:30 a.m.

Former Rustin swim coach Kenneth Fuller waived his preliminary hearing on Tuesday after a bondsman posted his bail on Sunday, May 20. Fuller's next appearence in court is scheduled for June 14 where he will be formally arraigned. Fuller stands accused of several counts of institutional sexual assault after he had sex with a female minor member of his swim team at Rustin. Fuller allegedly had sex with the minor on three separate occasions between April 27 and May 5. According to police, Fuller also provided the minor with alcohol on each occasion where they had sex. Former Rustin swim coach Kenneth Fuller was arraigned Wednesday on charges including institutional sexual assault after he had sex with a female minor high school student. Magesterial District Judge Daniel Maisano set Fuller's bail at $250,000. Fuller could not post bail and was sent to Chester County Prison where he awaits trial. Fuller was arrested Wednesday after it came to light that he had sex with a female member of his team on at least three separate occasions between April 27 and May 5. Besides three counts of institutional sexual assault, Fuller has also been charged with corruption of minors, furnishing alcohol to a minor and endangering the welfare of children.
