Enacting a state budget

The House, Senate and governor have agreed to spend approximately $27.656 billion for next year’s state budget; the funding level is sustainable, less than inflation, and below the 2008-09 spending of $28.3 billion. House budget priorities have been funding K-12 education, including an expanded Educational Improvement Tax Credit (EITC); higher education; and county human service programs.

  • HB 2368 (Rep. John Payne, R-Dauphin):  Inserts mandatory Dodd-Frank lending limits language into the Banking Code to require the Commonwealth to consider credit exposure to derivatives transactions, removes the cap on the number of individuals that can be beneficiaries of a deposit account and increases the state-chartered banks’ ability to invest in branches based on 100 percent of capital assets.
  • HB 2369 (Rep. Dan Truitt, R-Chester):  Increases public disclosure and enforcement by the Department of Banking and implements the federal Consumer Financial Protection Act of 2010.
  • HB 2370 (Rep. Carl Metzgar, R-Bedford/Somerset):  Removes redundant disclosures related to variable rate mortgage loans, as they have been pre-empted by federal banking laws and clarifies the bank interest rate exemption from the Loan Interest Protection Law.

EDUCATION, 11 a.m., Room 60, East Wing

  • Informational meeting on HB 2468 (Rep. Jim Christiana, R-Beaver):  Establishes an educational improvement tax credit where the total aggregate amount of all tax credits increases incrementally each year until it reaches the maximum in fiscal year 2014-2015 of $300 million, thereafter subject to annual adjustment based on the consumer price index and establishes an educational opportunity scholarship program, with a maximum scholarship amount of $8,500 for students without disabilities, and $15,000 for students with disabilities.

 
Session
On Monday, the House will convene at 1 p.m. for legislative business. The members will vote the uncontested calendar and Rule 35 resolutions.

  • HB 1078 (Rep. Margo Davidson, D-Delaware):  Authorizes the Office of Safe Schools to develop telephone hotlines for individuals to anonymously report potential or actual violence or the possession of weapons on school property.
  • HB 2348 (Rep. Duane Milne, R-Chester):  Requires the Department of Revenue to automatically authorize a filing extension of 30 days for corporate taxpayers if a federal extension has been granted and extends the time period a corporation has to notify the Department of Revenue that the total taxable income on the annual report has been changed by a federal agency from 30 days to six months.
  • HB 2460 (Rep. Stephen Bloom, R-Cumberland):  Road designation: the Marine Lance Corporal Nicholas B. Morrison Memorial Highway.
  • SB 237 (Sen. Tina Tartaglione, D-Philadelphia): Withholds distribution of traffic-fine revenue, earned through Pennsylvania State Police traffic stops, to municipalities that provide fewer than 40 hours per week of local police coverage or that have a population exceeding 3,000 people, and redirects the money to state police cadet training.
  • SB 351 (Sen. Lisa Baker, R-Pike/Wayne/Wyoming/Luzerne/Monroe/Susquehanna):  Establishes Good Samaritan civil immunity for the use of an automated external defibrillator and extends Good Samaritan civil immunity for bystanders and off-duty emergency response providers.
  • SB 367 (Sen. Don White, R-Indiana/Armstrong/Butler/Clearfield/Westmoreland):  Authorizes the Department of General Services to make and execute contracts or leases in the name of the Commonwealth for the mining or removal of valuable coal, oil, natural gas, coal bed methane, and limestone which may be found in or beneath state-owned land; establishes the process for advertising and bidding; and sets forth the distribution of revenue.
  • SB 637 (Sen. Kim Ward, R-Westmoreland):  Requires contractors and subcontractors on public works projects to verify employee eligibility using E-Verify.
  • SB 707 (Sen. Tim Solobay, D-Greene/Allegheny/Beaver/Washington/Westmoreland):  Extends to military spouses the same protections granted to members of the military when they take an educational leave of absence due to a deployment.
  • SB 866 (Sen. Kim Ward, R-Westmoreland):  Reauthorizes and expands the Volunteer Fire Company and Volunteer Ambulance Service Grant Act until 2016.
  • SB 1122 (Sen. Jake Corman, R-Juniata/Perry/Centre/Mifflin/Union):  Appropriation: Pennsylvania State University and the Pennsylvania College of Technology.
  • SB1123 (Sen. Jake Corman):  Appropriation: University of Pittsburgh.
  • SB 1124 (Sen. Jake Corman):  Appropriation: Temple University.
  • SB 1125 (Sen. Jake Corman):  Appropriation: Lincoln University.
  • SB 1126 (Sen. Jake Corman):  Appropriation: University of Pennsylvania.
  • SB 1263 (Sen. Pat Browne, R-Lehigh/Monroe/Northampton):  Establishes that the total amount appropriated for the “Reed Act – Employment Insurance” and the “Reed Act – Employment and Unemployment Insurance” shall not exceed the limitation provided in section 903 of the Social Security Act.
  • SB 1386 (Sen. Elder Vogel, R-Allegheny/Beaver/Lawrence):  Requires the Department of Environmental Protection to review and reevaluate the state implementation plan under the Federal Clean Air Act in relation to compliance requirements for low Reid Vapor Pressure gasoline, authorizes the governor to submit a request to the Environmental Protection Agency to waive the requirements in the event of a supply disruption, and allows for the repeal of regulations relating to control of volatile organic compounds from gasoline-dispensing facilities.

  • HB 1718 (Rep. Tom Creighton, R-Lancaster):  Under the Municipalities Planning Code, clarifies that the municipality may only retain 10 percent of the original financial security for public improvement projects as they are completed, extends the time period for a property owner to dispute the amount of inspection or review fees from 30 and 45 days, respectively, to 100 days, and clarifies arbitration over disputed fees.
  • HB 1719 (Rep. Tom Creighton):  Under the Municipal Authorities Act, clarifies that the municipality may only retain 10 percent of the original financial security for public improvement projects as they are completed, extends the time period for a property owner to dispute the amount of inspection or review fees from 20 working days to 60 days, and clarifies arbitration over disputed fees.
  • HB 2159 (Rep. Glen Grell, R-Cumberland):  Updates the provisions in the Commercial Code relating to secured transactions.
  • HB 2467 (Rep. Nick Micozzie, R-Delaware):  Eliminates the requirement that salvage title documents be notarized for vehicle owners that transfer a vehicle title to an insurer.

  • HB 2187 (Rep. Curtis Thomas, D-Philadelphia):  Establishes the Pennsylvania Interagency Council on Inmate Reentry and sets forth the membership and duties of the council.
  • HB 2485 (Rep. Glen Grell, R-Cumberland):  Clarifies that a remittance transfer in the form of a check, draft, or other paper instrument is subject to Division 4A of the Pennsylvania Commerce Code and that electronic remittance transfers are subject to the federal Electronic Funds Transfer Act.
  • SB 1535 (Sen. Stewart Greenleaf, R-Bucks/Montgomery): Increases the rates charged for copying medical records in response to a subpoena for production of evidence.
  • HR 351 (Rep. Bill Kortz, D-Allegheny):  Memorializes the Supreme Court of Pennsylvania to approve and adopt Rules of Criminal Procedure 113, 513, and 513.1 and their official comments.

PROFESSIONAL LICENSURE, 10 a.m., Room 39, East Wing

  • HB 2354 (Rep. Gordon Denlinger, R-Lancaster):  Under the CPA Law, amends the definition of “attest activity” to include audits performed in accordance with standards established by the Financial Accounting Standards Board or the International Accounting Standards Board and replaces the licensure requirement of 400 hours of attest activity with any type of service or advice involving accounting, attest, compilation, management advisory, financial advisory, tax or consulting deemed satisfactory by the State Board of Accountancy.

  • HB 1643 (Rep. John Evans, R-Crawford/Erie):  Limits civil liability for landowners who allow their property to be used for an approved snowmobile and ATV information, safety education and training program.
  • SB 469 (Sen. David Argall, R-Schuylkill/Berks/Carbon/Lehigh/Monroe/Northampton):  Adds walking, jogging, bicycling, exercising, and horseback riding to the recreational activities covered by the Recreational Use of Land and Water Act.
  • SB 1115 (Sen. Pat Browne, R-Lehigh/Monroe/Northampton):  Establishes the Legislative Commission on Special Education Funding, provides for the powers, duties and construct of the commission, and establishes a new equitable special education funding formula.
