Report: Mistrial Declared in Mengel Case

Common Pleas Court Judge Thomas Gavin rules the jury to be unavoidably tainted.

The Daily Local reports that Common Pleas Court Senior Judge Thomas Gavin declared the homicide case against Morgan Mengel a mistrial due to the jury being unavoidably tainted.

Judge Gavin ruled that the defendent could not get a fair trial after a statement by a West Goshen police officer Thursday, says the Daily Local.

The Daily Local also reports that the statement was ruled inadmissible but Senior Judge Thomas Gavin said that he saw no way for the jury to completely disregard it.

The Daily Local also reports that Gavin said that Mengel would be retried as soon as convenient. 

Mengel stands accused of conspiring to murder her husband in 2010.
